参议员辛西娅·卢米斯（@SenLummis) is running out of patience. In a pointed public statement, the Wyoming Republican challenged her Democratic colleagues to explain what is still standing in the way of passing the Digital Asset Market Clarity Act, saying she has no idea what else can be conceded after nearly a year of negotiations.

"After nearly 11 months of giving almost everything asked of us, I genuinely don't know what else my Democrat colleagues need before we act," Lummis said.

The CLARITY Act has already cleared significant hurdles. The House passed the bill on July 17, 2025, by a vote of 294 to 134, with every Republican and 78 Democrats voting in favor. The Senate Banking Committee then approved its version on May 14, 2026, by a 15-to-9 vote. Despite that progress, a full Senate floor vote has yet to materialize.

Lummis has argued consistently that the stakes extend beyond politics. She says the CLARITY Act would protect customer crypto assets from being swept into bankruptcy during a company failure, pointing to the collapse of platforms like Celsius and Voyager as a warning of what happens without adequate protections.

Democrats Dig In Over Ethics Provisions

The main sticking point remains an ethics provision barring top U.S. officials, including President Trump, from supporting or participating in crypto projects. Trump agreed to a compromise, but Democrats say the restrictions do not go far enough. Republicans hold 53 Senate seats, but the bill needs 60 votes, requiring support from at least seven Democrats.

Senate Democrats have signaled they will block the legislation without ethics safeguards tied to President Trump's crypto holdings. Closed-door consultations at the White House were attended only by Trump and Republican figures, with Democrats excluded from the meeting, leaving negotiations in a deadlock.

The clock is now pressing hard on all sides. The bill will not receive a Senate floor vote before the August 7 recess, with Senate Majority Leader John Thune acknowledging the chamber lacks time to complete debate, amendments, and a cloture vote before lawmakers leave Washington. Lummis has emphasized the importance of passing the legislation before the August recess to avoid potential delays tied to the 2026 midterm elections.

Lummis has said that failure in 2026 likely delays comprehensive federal digital asset regulation until 2030, after a new Congress of unknown composition. Prediction markets reflect growing scepticism: Polymarket odds on the CLARITY Act becoming law in 2026 have fallen to approximately 28%.
