The Clarity Act: America's Play for Digital Asset Leadership
At the center of Trump's crypto agenda is the Digital Asset Market Clarity Act, known on Capitol Hill as the Clarity Act. The legislation would create a federal rulebook for issuing, trading, and holding digital assets, dividing oversight between the Securities and Exchange Commission and the Commodity Futures Trading Commission, setting standards for exchanges and other intermediaries, and defining how decentralized-finance developers and protocols would be treated.
Trump urged the Senate to pass the Digital Asset Market Clarity Act, warning lawmakers that China could seize leadership in both crypto and artificial intelligence if the United States fails to act. The warning reflects a broader geopolitical framing the administration has adopted, casting the legislation as essential to maintaining American dominance against state-level competition from China and Japan.
The House passed H.R. 3633 on July 17, 2025, by 294 votes to 134, with all voting Republicans and 78 Democrats supporting the measure. On May 14, 2026, during a formal markup hearing, the Senate Banking Committee advanced the Clarity Act by a vote of 15 to 9, though two Democrats indicated their committee votes did not guarantee floor support without further progress on an ethics provision addressing government officials' ties to the crypto industry.
The bill's text was expanded significantly over the past year, with a deadlock in much of 2026 driven by banking lobby chiefs clashing with crypto exchanges over concerns about stablecoin yield, while Democrats pushed for stronger ethics language. The immediate arithmetic obstacle is that the bill needs 60 votes, while Republicans hold only 53 Senate seats.
Some Washington lawmakers have criticized the way the Trump family has profited from digital asset ventures, including the president's memecoin $特朗普 and the World Liberty Financial project, though Trump and the White House have denied any conflicts of interest. With the Senate's August recess approaching, the window for 2026 passage remains narrow but open.
